Terms of Service
1. Agreement
By adding Vigil to a Discord server, running any of its commands, or submitting a report through it, you agree to these Terms of Service. If you do not agree, do not use Vigil.
2. Who may use Vigil
You must be at least 13 years old and able to use Discord under Discord's Terms of Service and Community Guidelines. A server administrator who adds Vigil to a server agrees to these Terms on behalf of that server and confirms that they have the authority to do so.
3. What Vigil does
Vigil is a logging bot. When a server administrator enables it, Vigil stores and posts information about deleted and edited messages, username, nickname, and profile picture changes, and voice channel joins, leaves, and moves. It also provides a member lookup command, data deletion commands, and a report command for sending issues to the operator. The Privacy Policy describes what information is involved.
4. Server responsibilities
A server administrator who enables Vigil is responsible for:
- Telling members, before logging begins, that their messages and activity are being recorded. Vigil does not replace that notice.
- Using the logs only for lawful purposes related to the server, such as moderation, safety, and dispute review.
- Limiting access to the log channels and the member lookup command to people who need it.
- Responding to member requests about their data, or referring those requests to the operator.
- Complying with all laws that apply to the server and its members, including privacy and recording laws.
5. Acceptable use
You agree not to:
- Use Vigil or its logs to harass, threaten, dox, stalk, or track people, or to expose private information about them.
- Use Vigil to commit or support any illegal activity.
- Attempt to access the operator's computer, database, or accounts, or to extract stored data by any means other than the commands Vigil provides.
- Interfere with or overload Vigil, including by sending spam or automated reports.
- Submit false, abusive, or misleading reports.
- Attempt to copy, decompile, reverse engineer, or modify Vigil.
6. Availability
Vigil is provided free of charge and on an as available basis. It runs on a personal computer, so it may be offline during maintenance, power or internet outages, or restarts. Features may change, be limited, or be discontinued at any time without notice.
7. Access and removal
A server administrator can remove Vigil at any time using Discord's controls. The operator may suspend Vigil in any server, limit commands, or revoke access for any user who violates these Terms, where the operator believes this is necessary to protect members, the service, or the law.
8. Intellectual property
Vigil, including its software, name, and design, belongs to the operator and is protected by law. These Terms do not give you ownership of Vigil or permission to copy its software. You may use Vigil only as described here.
9. Disclaimer of warranties
Vigil is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of accuracy, reliability, availability, merchantability, and fitness for a particular purpose. Logs can be incomplete, for example when messages were sent before Vigil was added or when Discord does not send an event. The operator does not guarantee that stored information is complete or error free.
10. Limitation of liability
To the fullest extent permitted by law, the operator is not liable for any indirect, incidental, special, or consequential damages, or for loss of data, profits, or goodwill, arising from your use of or inability to use Vigil. Vigil is free, so the operator's total liability for any claim is limited to the amount you paid for Vigil, which is nothing, except where the law does not allow that limit.
11. Indemnity
You agree to indemnify and hold harmless the operator from claims arising from your use of Vigil, your server's logging practices, or your violation of these Terms.
12. Governing law
These Terms are governed by the laws of the State of Texas and applicable federal law of the United States, without regard to conflict of law rules. Any dispute that is not resolved informally will be brought in the state or federal courts located in Dallas County, Texas.
13. Changes
The operator may update these Terms. The updated version will be posted on this page with a new effective date. Continued use of Vigil after an update means you accept the updated Terms.
